governor gavin newsom signs critical prescribing legislation

The Osteopathic Physicians and Surgeons of California is pleased to announce that Gov. Gavin Newsom has signed OPSC supported Assembly Bill 149 (Cooper). OPSC along with other physician organizations advocated extensively for this important legislation.


In December of 2018, the Department of Justice released new regulations requiring prescribers to use prescription documents with a unique 15-digit serial number when prescribing schedule 2-4 controlled substances by January 1, 2019. Unfortunately, the department did not include a transition period in the new regulations. As a result, many patients were unable to obtain critical medications.


AB 149 will delay implementation of the new regulations until January 1, 2021, ensuring that patients will continue to have access to their medications. OPSC will send out an update to osteopathic physicians once the Department of Justice releases new requirements for prescription documents.


In the meantime, physicians will be able to use pads obtained before or after January 1, 2018. Both sets of pads will be accepted until DOJ can come up with guidelines are requirements for the new pads.

Osteopathic Manipulative Treatment Now Covered by Medi-Cal

The California Department of Health Care Services (DHCS) recently announced that Medi-Cal now covers Osteopathic Manipulative Treatment (OMT). The Medi-Cal Provider Manual states that OMT is reimbursable only when rendered by physicians skilled, trained and experienced in providing OMT services.


OMT coverage in Medi-Cal is the result of the tireless efforts of the staff and physician leadership at the Osteopathic Physicians and Surgeons of California (OPSC). While OMT coverage is an essential first step for osteopathic physicians in California, we continue to work with the Department to clarify regulations and expand coverage to the full potential of OMT. 


Currently, OMT coverage in Medi-Cal is limited to CPT codes 98925 and 98926 when billed in conjunction with ICD-10 diagnosis code M99.01, M99.02, M99.03, M99.04, or M99.05. The frequency of treatment is also limited to 12 procedures per year.


OPSC is committed to working with DHCS to expand OMT coverage beyond this initially limited definition. In the meantime, we urge physicians practicing OMT to consult the Medi-Cal Provider Manual for specific information on requesting reimbursement from the system.
